[2015 Highest 3055] - Defendants

1. On March 15, 2015, the Defendants’ co-principal-offenders, who were in the line of “F” as of March 15, 2015, at around 05:50, and were in the line of “F” operated by the victim E (the age of 42) located in Gwangjin-gu Seoul Special Metropolitan City, and were requested by the victim for two times from the victim to “abscam to interfere with other customers,” but the Defendants exercised power, such as continuing to see each other’s high character, talking, and scambling with the customer by scambling each other, and interfered with the victim’s restaurant business by force of approximately 45 minutes by driving in the restaurant even upon the request of the victim.

2. Defendant B, at around 06:40 on March 15, 2015, demanded the victim G, a police official, who was called up for 112 report by Defendant B, to submit an identification card at the F Branch, following the Defendant’s report by the business owner E, and the victim G, who was called up for 112 report, made a public insult, such as “schep” in front of four persons, including E and its surrounding police officers, “schepye”, “schee”, and “Ne that the police officer becomes Ah and D,” etc.

3. At around March 15, 2015, Defendant A: (a) arrested the victim G who was a police official before the F Branch on the charge of interference with the duties as described in paragraph (1) and arrested the victim G, who was a police official, on the charge of interference with the duties as described in paragraph (1); and (b) assaulted Defendant A with three times the shoulder of the above G, tightly pushed off three times with his arms, and throw the chest.

Accordingly, the defendant interfered with legitimate execution of duties concerning the police officer's 112 reporting and withdrawal duty and arrest of flagrant offenders.
