For the reasons indicated in its reasoning, the lower court recognized that the first instance court’s determination that the Defendant’s act was legitimate as self-defense with respect to the obstruction of performance of official duties among the facts charged in the instant case, and rejected the prosecutor’s grounds for appeal

Examining the reasoning in light of the record, the lower court did not err by misapprehending the legal doctrine on the requirements for the arrest of flagrant offenders, contrary to what is alleged in the grounds of appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
