1. The defendant on December 5, 1985, with respect to 34,314 square meters of forest land B in Yeongdeungpo-gun, Chungcheongnam-gun, Daejeon District Court in relation to the plaintiff.
Reasons
1. The Plaintiff is the owner of 34,314 square meters of forests and fields B in Chungcheongnam-gun, Chungcheongnam-do.
Although the defendant created superficies on the above real estate, the period of existence has expired.
Therefore, the defendant is obligated to implement the procedure for cancellation registration of the above superficies creation registration to the plaintiff.
2. Judgment based on the deemed confession based on recognition (Article 208 (3) 2 of the Civil Procedure Act).
