No person who carries out or has carried out affairs related to the prevention of and countermeasures against school violence shall divulge confidential information concerning aggressor students, victim students, or reporting or notifying persons that he/she has become aware of in the course of performing his/her duties or data.

As the principal of the D secondary school in Ulsan-gu, Ulsan-gu, the Defendant attempted suicide on April 28, 2017 due to school violence, and on June 15, 2017, in relation to the suicide case (hereinafter “school violence case”), the Defendant performed overall affairs related to school violence, such as early action, guidance, protection of aggressor students, and investigation of school violence.

In order to submit additional data to the Local Committee for Countermeasures against School Violence related to the above case of school violence, the defendant acquired personal information including the above E's experience in the division of labor, the parent-child's death, the personal information and the contents of deliberation and resolution of the Autonomous Committee for Countermeasures against School Violence, including the contents of the above E's father's taking the drug of the above E's father, and acquired the data of "if the case occurs after the occurrence of the case". The notice of the result of the Committee for Countermeasures against School Violence, the records of the E's life, the result of the examination of the above E's emotional behavior characteristics, files containing contents related to the above E's injury to the aggressor, F, G, and H, and the opinion of the counsel at the elementary school of the above E.

At around 10:00 on May 2, 2017, the Defendant: (a) was the principal of the above D secondary school school; (b) at the seat of the F, G, and H’s parents, etc. identified as the perpetrator with respect to the foregoing school violence case, “E’s father has a depression and decentralization disorder; and even at that time, the father attempted suicide at an elementary school; and (c) at that time, the mother returned to her early stage and was in her mother at her mother’s home.

The purport of “the disclosure of the personal information of victim students and students from home to home is likely to cause controversy between the parties to the dispute.”
