가등기에의한본등기절차이행
1. The defendant,
A. As to the portion of 1/2 out of the real estate listed in the attached Table 1 to the Plaintiff Free Co., Ltd.
1. Each of the real estates listed in Schedule 2 to 6, 9, and 13 (hereinafter “each of the instant real estates”) as stated in Schedule 1, 7, and 8 of the facts of the cause of the claim is owned by the Defendant Company.
Around June 16, 200, in order to secure the payment of the construction cost to C, D, and E (hereinafter “C, etc.”), a construction business operator, in the course of the new construction of each of the instant real estate, the Defendant Company completed the registration of each transfer of ownership rights claim right as described in paragraph (1) of the Disposition No. 1 with respect to each of the instant real estate. As the Defendant Company failed to pay the construction cost to C, etc., the Defendant Company agreed to transfer each of the instant real estate to C, etc. as payment for construction cost around October 200
However, around December 30, 2006, C, etc. transferred the right to claim ownership transfer based on the above provisional registration to F. F also transferred the right to claim ownership transfer on January 25, 2017 with respect to the 1/2 share of the real estate listed in attached Table 1, to the Plaintiff Freem Co., Ltd., and the right to claim ownership transfer on January 18, 2017 with respect to each real estate listed in attached Tables 2 through 6, 2017, to the Plaintiff A, and each right to claim ownership transfer on January 19, 2017, with respect to each real estate listed in Tables 9 through 13, 2, and 1/2 shares of each real estate listed in attached Table 7, 7, 8, and 9
2. Judgment made based on the deemed confession based on the basis of recognition (Articles 208 (3) 2, 150 (3) and (1) of the Civil Procedure Act).
