피고인은 2015. 5. 4.경 의정부시 의정부동 소재 금문 앞 노상에 주차된 피고인 소유 B QM5 승용차에서, 판매할 목적으로 주식회사 블랙야크(BLACK YAK)에서 상표등록(등록번호 : 제0380952호)한 가짜 블랙야크(BLACK YAK) 상표가 부착된 바람막이 16개 및 잠바 1개 등 별지 범죄일람표 기재와 같이 블랙야크(BLACK YAK, 등록번호 : 제0380952호), 데상트(DESCENTE, 등록번호 : 제0066230호), 몽클레어(MONCLER, 등록번호 : 제0373377호), 루이비똥말레띠에(Louis Vuitton Malletier, 등록번호 : 제0426944 ㆍ 0118012호), 구찌(GUCCI, 등록번호 : 제0564783호) 프라다(PRADA, 등록번호 : 제0379002호), 코우치(COACH, 등록번호 : 제0590350호), 크리스찬디올(Christan Dior, 등록번호 : 제0046320호), 살바토레페레가모(SALVATORE FERRAGAMO, 등록번호 : 제0449125호), 레이벤(RAY-BAN, 등록번호 : 제0046281호), 팬디(FEND등록번호 : 0125334호), 막스마라(MAX MARA, 등록번호 : 제0375329호), 톰포어드(TOMFORD, 등록번호 : 제0748137호), 발망(BALMAN, 등록번호 : 제0981507호), 젠틀몬스터(GENTLEMONSTER, 등록번호 : 제0981741호), 아르마니(ARMANI, 등록번호: 제0158260호), 샤넬(CHANEL, 등록번호 : 제0039352호) 등 총 17개 회사의 가짜 상표가 부착된 상품을 소지하였다.
