The judgment below

Examining the reasoning in light of the record, the court below’s rejection of the judgment of the court of first instance on the ground that there is no evidence of the crime of occupational breach of trust among the facts charged in this case, and the judgment of not guilty is justifiable. In so doing, the court below did not err by exceeding the bounds of the principle of free evaluation of evidence or by misapprehending

In addition, the prosecutor appealed against the guilty portion of the judgment of the court below, but did not submit any grounds for objection.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
