The defendant is a public official of Grade VI working as a local public official of Grade B administrative support and Grade C, who is in charge of identifying public opinion or mediating civil petitions for viewing and listening.

Around 11:00 on February 22, 2020, the Defendant discovered documents “the current status of the occurrence of a positive crona 19” distributed at the Korona 19 meeting related to the Korona 19 held in the E market at around 09:00 on the same day at the office of the second floor notification department of B, the second floor in D, and at around 09:0 on the same day. The said documents contain personal information, such as personal information, such as H, I, J’s gender, age, occupation, family relation, and family relation, which are secrets in the course of performing his/her duties.

At the time, the Korea Centers for Disease Control and Prevention established the Ministry of Health and Welfare, on January 20, 2020, when an epidemiological investigation of all confirmed patients was conducted in accordance with the relevant Acts and subordinate statutes after the occurrence of the confirmed patients No. 191, and information related to infectious diseases, which was not in compliance with the procedures prescribed by the Acts and subordinate statutes, is leaked due to the circumstance where the results were promptly disclosed, there was a risk of causing serious trouble to government infectious disease control duties, such as influence of false information or influence of the people without any grounds, and in addition, influence of the results of the investigation in accordance with the Acts and subordinate statutes.

Nevertheless, at around 11:00 on the same day, the Defendant taken a photograph of the above documents using his smartphone at the office room of the above department of notification, and sent the photo files to the Defendant’s wife K, ASEAN L, son, son M, and Gaman N in the Defendant’s cell room.

As a result, the Defendant disclosed confidential information in the course of performing official duties, and at the same time disclosed personal information of coaches 19 viruses patients and their contactors.
