On July 3, 2009, the Plaintiff filed a lawsuit against D et al. with the Seoul Central District Court No. 2008Da41913, and paid 43,041,90 won jointly with E and severally with D, and 25% per annum from February 20, 198 to August 31, 1998; 20% per annum from September 1, 1998 to December 18; 20% per annum from the day following the date of execution to May 7, 2009; 20% per annum from September 1, 1998 to December 198; 30% per annum from the day of execution to 198; 49% per annum from the day of completion to 20% per annum from the day of completion; and 20% per annum from the day of D et al. 196 to 298, 2097.

B. Meanwhile, as of April 12, 1997, the registration of creation of a mortgage was completed in the name of the defendant as of April 14, 2005, the maximum debt amount of KRW 70,000,000, and the debtor D and the mortgagee H as of April 14, 2005. As of September 30, 1997, the registration of creation of a mortgage was completed in the name of the defendant as of April 14, 2005, the registration of creation of a mortgage was completed in the name of the defendant as of September 30, 1997, the maximum debt amount of KRW 70,000,000,000, and the registration of creation of a mortgage near the Defendant

C. On October 2, 2014, upon the Plaintiff’s request, the decision to commence the compulsory auction of real estate to this court C (hereinafter “instant auction procedure”). The Plaintiff submitted a claim statement of KRW 193,957,886 as a person holding a right to request auction and a person holding a provisional seizure. The auction court distributes each of the Defendants KRW 70,00,000 on the date of distribution open on November 12, 2015.
