2. Articles 257 (1) and 208 (3) 1 of the Civil Procedure Act of the applicable provisions of Acts (a judgment by non-drawing);

Article 3(1) main sentence of Article 3(1) of the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings for Partial Dismissal was promulgated on September 25, 2015 as amended and enforced on October 1, 2015, and Article 2(2) of the Addenda of the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings (Presidential Decree No. 26553) provides that “The statutory interest rate for a case pending in a court at the time this Decree enters into force shall be the interest rate under the former provisions until September 30, 2015 with respect to which the first instance trial proceedings have not been concluded, and from October 1, 2015, the interest rate under the amended provisions of this Decree shall apply.” Thus, the delivery of a copy of the complaint of this case from September 18, 2015 to September 30, 2015 shall be dismissed at the rate exceeding 15% per annum, and the damages for delay shall be dismissed.
