1. Defendant A shall be punished by imprisonment with prison labor for six years and by imprisonment with prison labor for two years;
2. One punishment (No. 1) shall be imposed on seized crowdfundings;
Punishment of the crime
1. Defendant A was sentenced to three years of imprisonment for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at the Seoul Eastern District Court on December 17, 2004, and was sentenced to five years of imprisonment for the same crime at the Seoul Southern District Court on June 5, 2008, and finally completed the execution of sentence on April 15, 2013, Defendant A was finally sentenced to seven times of the records of punishment for the same kind or larceny (including one protective custody disposition).
2. Criminal facts;
A. Defendant A habitually, around 20:00, in combination with G and H on May 25, 2013, at 104, 2013, around 20:00, Defendant A and B reported the network outside of the area; Defendant A and G entered 103, the house of the victim I through the following benda window; Defendant A had money and valuables equivalent to KRW 17.65,00 won in total, including the net gold ging, and stolen it from that time until December 26, 2013; Defendant B and H, G, J, K, etc. together with Defendant B and Ha, from May 25, 2013 to December 26, 2013; Defendant A and C attempted to commit a theft over two or more occasions, as indicated in attached Table 24, “the attempted to commit a crime” during the period from May 25, 2013 to December 26, 2013.
B. On November 26, 2013, Defendant B joined with Defendant A at 107, Ann-gu L Apartment at Ann-gu, Ann-si, Ann-si, Ann-si, Ann-si, and Defendant B parked in the apartment complex near the said apartment complex by driving Defendant A on a cargo vehicle of 1 ton of M (hereinafter “instant cargo vehicle”); and then parked in the area near the said apartment complex; Defendant B reported the network outside the above 107 unit; Defendant A entered the 203 unit of the victim N, the sum of the market price of which is KRW 2,00,000,000, via a ben-si window, and cut off it with approximately two gold bars, the sum of the market price of which is KRW 2,00,000.
