All of the prosecutions of this case are dismissed.
The defendant of a public lawsuit room is the representative of C in Si Heung-si, who is an employer who runs a manufacturing business using approximately seven regular workers.
1. Violation of the Labor Standards Act;
A. The Defendant, from February 10, 2006 to November 2, 2012, did not pay 8,714,530 won of wages, and did not pay within 14 days from the date of retirement without any agreement between the parties on the extension of the date.
B. The Defendant, even from August 12, 201 to June 21, 2013, had the said workplace employ and work E, did not pay wages of KRW 15,391,680, and did not pay wages within 14 days from the date of retirement without agreement between the parties on the extension of the date.
C. The Defendant, even from September 13, 2005 to November 2, 2012, had the said workplace employ and work F, did not pay wages of KRW 9,856,970, and did not pay wages of KRW 9,856,970 within 14 days from the date of retirement without agreement between the parties on the extension of the date.
The Defendant, even from September 1, 201 to June 30, 2013, did not pay wages of KRW 8,714,530, and did not pay wages of KRW 8,714,530 within 14 days from the date of retirement without agreement between the parties on the extension of the date.
2. Violation of the Guarantee of Workers' Retirement Benefits Act;
A. The Defendant, from February 10, 2006 to November 2, 2012, did not pay retirement allowance of KRW 15,096,988, and did not pay retirement allowance of KRW 15,096,988 within 14 days from the date of retirement without any agreement between the parties on the extension of the date.
B. The Defendant, even from August 12, 201 to June 21, 2011, had the said workplace employ and work E, did not pay retirement allowances of KRW 3,956,085, and did not pay retirement allowances within 14 days from the date of retirement without any agreement between the parties on the extension of the date.
C. The Defendant, from September 13, 2005 to November 2, 2012, employed F and had the said workplace work for F, and, even from November 2, 2012, retired from the date of retirement without agreement between the parties on the extension of the date.
