Punishment of the crime
Defendant
A is the representative director of B of the sales business entity B, which was constructed above G and two parcels in Jeju, and Defendant B is a corporation established for real estate development business.
1. Where a defendant A intends to sell a building in units, he/she shall make a report thereon to the competent permitting authority under the Building Act, and receive notice of acceptance of a sale report, and make a public offering of persons entitled to purchase the building through the advertisement;
Nevertheless, on September 18, 2015, the Defendant prepared an offer for parcelling-out under H327, which is a building for which the Defendant would sell through the parcelling-out agency, without filing a report at the KRW 327,00,000, and received KRW 2,000,00 in the name of the subscription money from I from September 16, 2015 to December 10, 2015, the Defendant recruited 379 households among the 484 households, among the 484 households, by preparing an offer for parcelling-out without being notified of the receipt of the report for parcelling-out under the pretext of the payment for the subscription money, and without being notified of the receipt of the report for parcelling-out under the pretext of the payment for the subscription money.
2. A, the representative of B accused, recruited a person who is not an open recruitment by the advertisement of sale without being notified of the acceptance of the report of sale in lots as shown in paragraph 1 with respect to the Defendant’s business.
