"2015 Highest 1188"

1. On December 18, 2009, the Defendant had no intention or ability to pay money even if he/she borrowed money from others, since he/she had operated pro-friendly C’s medical instruments business or supplied medical instruments to the trader and received money from the trader; there was no property or income; there was no property or income; there was no amount of personal debt; there was approximately KRW 4-50 million; and there was no circumstance that he/she could not engage in bank transactions with bad credit standing since 2006.

Nevertheless, on December 18, 2009, the Defendant made a false statement to the effect that “The office expenses incurred in providing medical services shall be remitted to the victim E, and shall be repaid after the transfer of the office expenses to the victim,” by phoneing the victim E at the medical equipment office of the Defendant, who is the punishment of the Defendant in Busan-gu, Busan-do.”

The defendant received 900,000 won from the victim's bank account (Account Number F) in the name of friendly C used by the defendant at the time.

2. On April 9, 2010, the Defendant made a false statement to the effect that, even if he/she borrowed money from others as stated in the foregoing paragraph (1), he/she did not have any intent or ability to repay the money, the Defendant called the victim at H located in Busan Shipping Daegu G, Busan, on April 9, 2010, to the effect that “if he/she lends money to purchase a medical machine, he/she would have to repay the money without fail by the end of April.”

The Defendant received 6 million won from the victim to the above national bank account in the name of C.

3. On May 12, 2010, the Defendant made a false statement to the effect that “The Defendant would receive money from others even if he/she borrowed money from others as stated in the foregoing paragraph (1) but did not have any intent or ability to repay it,” on May 12, 2010, at the Postnatal Care Center located in the Busan Dong-gu, Busan, the Defendant would make a false statement to the effect that “The Defendant would receive money from the Defendant to receive money from the Defendant, if he/she gets out of one machine, and will receive money from the Defendant to repay the money to the full amount.”

The defendant is against the victim.
