For the reasons indicated in its reasoning, the lower court upheld the first instance judgment that acquitted the charged facts of this case on the ground that there was no proof of the relevant crime.

In light of the records, the court below did not err by misapprehending the facts against the rules of evidence or by misapprehending the legal principles as to the grounds for denying the illegality of the crime of defamation, as alleged in the grounds of appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
