Punishment of the crime
1. Defendant A and B (Crimes related to the Construction of New E) are persons performing the Construction of New E in Daejeon-gu H by being awarded a contract for the Construction Industry (State) with the representative director of the G G located in the public city F in the public city, and Defendant A is a person who performs the Construction of New E in the public city of Daejeon-gu under a contract with Defendant B to perform the Construction of New E.
A. Defendant A did not pay KRW 1,190,00 for the total wages of KRW 10,960,000 for seven workers within 14 days from the date of retirement without an agreement between the parties concerned, including the fact that he/she did not pay KRW 1,190,00 from February 1, 2015 to February 12, 2015, in accordance with the direction of the Defendant, in relation to the above structural construction work at the site of the said new dormitory construction work.
B. Where a business has been executed two or more times in Defendant B construction, if the subcontractor fails to pay wages to his employee, the immediate upper-tier supplier shall be jointly and severally liable with the sewage supplier for the wages of the employee employed by the sewage supplier.
The Defendant, as a direct contractor A with respect to the above structural construction, did not pay the total of 46,385,00 won to 22 employees as shown in the table of crime Nos. 1 through 3, 5, and 23, and the Defendant did not pay wages to employees even though he was jointly and severally liable for payment of wages.
2. Defendant C (Crimes related to the payment of wages with respect to the J Corporation) Defendant C (Defendant) had worked as the site warden from November 2, 2014 to December 19, 2014 at the work site of Sejong-si, and had worked as the site warden from November 2, 2014 to December 19, 2014, and KRW 5,008,000 of the L wage of workers employed as a tree during the period from November 2, 2014 to December 16, 2014, within 14 days from the date of retirement without agreement between the parties.
