1. The Defendant: (a) within the scope of the property inherited from the deceased B, the Plaintiff KRW 74,412,00 and the Plaintiff’s amount of KRW 74,412,00.
Comprehensively taking account of the purport of each statement in Gap evidence Nos. 1 through 6, the plaintiff supplied the deceased Eul with feed from September 1, 1996 to October 31, 1998 in accordance with the agreement with the deceased Eul. The fact that the deceased Eul did not pay feed of KRW 74,412,00 in the net B, while the defendant inherited the deceased Eul's property and debts on November 26, 2004. However, it is recognized that the defendant was sentenced to qualified acceptance by the Chuncheon District Court 2005Ra30 on January 25, 2005.
Therefore, the defendant is obligated to pay to the plaintiff 74,412,00 won within the scope of the property inherited from the deceased B and damages for delay calculated at the rate of 15% per annum from April 8, 2017 to the day of complete payment, which is the day following the day when the copy of the complaint in this case was served to the defendant, as requested by the plaintiff.
The plaintiff's claim is accepted.
