A defendant shall be punished by imprisonment for not less than eight months.
except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
Any person who intends to engage in a credit business shall register with the competent authority, and the unregistered credit service provider shall not receive interest exceeding 30 percent per annum.
1. The Defendant, without registering the credit business, engaged in the credit business, as described in paragraph 2, with the trade name “B” without registering the credit business.
2. The Defendant exceeding the interest rate shall:
A. On November 28, 2013, in one’s own vehicle parked in front of the Yongsan-dong community service center in Seocho-si, Chungcheongnam-si, Seoul, borrowed 9,40,000 won per day after deducting 60,000 won from the commission, subject to the repayment of 1,30,000 won per day for 65 days, and collected 41,000 won per annum equivalent to 381.6% per annum;
B. On January 15, 2014, D, which was parked in the B-dong, Sung-dong, Sung-dong (hereinafter referred to as the “S-dong, Sung-dong”), loans 1,90,000 won for the actual principal after deducting 1,00,000 won from D under the condition that D shall be repaid for 65 days each day by 40,000 won of principal and interest, and collects 10,000 won per annum equivalent to 368.3% per annum;
C. On February 4, 2014, at the F Office located in Gyeonggi-si, the sum of KRW 60,000 per day to KRW 3,722,00,000 per day, G, subject to reimbursement of KRW 1,280,00 per annum, shall be loaned for the number of days per actual days after deducting KRW 1,280,000 per annum from KRW 31.2% per annum; and
D. On March 15, 2014, on the condition of receiving 60,000,000 won of the principal and interest each day from the window dressing point on the trade name in the Dongcheon-dong-dong-dong-dong-dong-dong-si for 65 days, H, subject to the repayment of 3.9,000,000 won for 1.55,00 won per annum, loans 2.85,00 won per annum and 11,000 won per annum;
E. On April 2, 2014, on the condition that at the J restaurant located in the I of Sejong-si, the principal amount of KRW 40,000,000 per day shall be repaid in 65 days each day by Do joint 2,60,000,000 per annum, and the principal shall be repaid in 1,90,000 won per annum, and shall be charged five times each by 468.3% per annum;
(f) on April 11, 2014, at the Lhouse located E in racing-si.
