1. The Defendant: (a) KRW 20 million to the Plaintiff; and (b) KRW 5% per annum from December 24, 2013 to October 17, 2014 to the Plaintiff.
1. Facts of recognition;
A. 1) The Plaintiff entered into the instant business transfer contract with the trade name “D” in the 1st, 2, and 3 of the 1st, Gwangju City shopping mall (hereinafter “the instant Taekwondo hall”).
(2) On April 26, 2013, while operating the Taekwondo hall, the agreement between Nonparty E and Nonparty E on April 26, 2013, transfers all of the business of the Taekwondo hall of this case to KRW 110 million premium, such as a book, stating the source of 140 and contact details (hereinafter “instant transfer agreement”).
(2) The Plaintiff and E concluded a special agreement at the time of the conclusion of the instant transfer of business, and the Plaintiff cannot open and take over the Taekwondo hall within 3 km radius from the instant Taekwondo place after the date of the transfer of business, and the Plaintiff agreed to pay twice the premium as compensation for damages.
3) The Defendant served as a leader and a criminal in the instant Taekwondo field. On May 24, 2013, the Plaintiff and E obtained authentication on the instant contract for the transfer of business (Evidence A) and added to the special terms and conditions that “B criminal cannot open the painting business within 2-3 km from the instant Taekwondo place” (hereinafter “G Taekwondo place”) with the name of “G” from May 27, 2013 to 78 meters away from the instant Taekwondo place.
(3) On July 8, 2013, the Defendant: (a) had tried to obtain and transfer the instant Taekwondo hall business from the head of the G Taekwondo hall to the extent of E per week; and (b) Nonparty H had tried to obtain and transfer the instant Taekwondo hall business from the head of the G Taekwondo hall to the name of “J” in the name of “J” (hereinafter referred to as “J Taekwondo hall”).
Around August 2013, 2013, the defendant was the leader from J Taekwondo to October 20 of the same year. D.
The defendant around June 9, 2013, around June 2013, the Taekwondo ground of this case is to be applied to the originals who were enrolled in the Taekwondo ground of this case or their parents.
