A. 나. 피고인은 2014. 9. 2. 15:30경 강릉시 F 피해자 G(76세), 피해자 E(여, 76세)의 집 앞에서 밭일을 하고 귀가하는 피해자 G을 따라가 “야, 씨팔놈아, 내가 예전에 네 마누라 대상포진 걸린 것을 고쳐주었는데 왜 돈을 안 주냐, 사람이 은혜를 입었으면 값을 줘야 될 게 아냐, 이 새끼 눈까리를 확 찔러서 빼내 버릴라”라고 말하면서 한손으로 피해자 G의 멱살을 잡고 다른 한손으로는 눈을 찌를 듯한 행동을 하여 피해자 G을 폭행하고, 계속하여 이를 말리는 피해자 E에게 “씹년아, 개 같은 년아, 칼로 배지를 콱 찌른다, 돈 내놔라, 내가 니년 대상포진도 고쳐주었는데 이런 금 귀걸이를 달고 다니면서 왜 돈을 안줘”라고 욕설을 하며 피해자 E의 왼쪽 귀를 잡아당겨 바닥에 귀걸이가 떨어지게 하고 양손으로 멱살을 잡고 흔드는 등 피해자 E를 폭행하였다.
