1. On November 29, 2018, around 15:00 on November 29, 2018, the Defendant: (a) obtained a copy of the Kakao Bank’s C’s physical card that the victim C lost on the street near the sub-city B bus platform; and (b) did not take necessary procedures, such as returning it to the victim; and (c) took on his/her thought that he/she had it.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

Fraud and the Defendant violated the Specialized Credit Financial Business Act: (a) around November 30, 2018, at the F convenience point operated by the victim E located in Bupyeong-si, Busan-si; (b) as if the e-mail card acquired as mentioned in the above paragraph (1) was presented to the victim as if the e-mail card was one of the means of settlement; and (c) on the same day, the victim received the e-mail tobacco amounting to KRW 4,100 (4,100) from the victim; and (d) one was issued from the victim in the same manner as at around 04:20 on the same day, if the e-mail card was in excess of the

Accordingly, the defendant deceivings the victim to receive property, and illegally uses the lost personal check card.

On November 30, 2018, the Defendant attempted to acquire one of the instant cream cards, which he/she acquired as stated in the foregoing paragraph 1, from the first convenience point where the victim H in Bupyeong-si works as an employee, presented to the victim as if he/she was his/her own card, and had it presented to the victim as a means of settlement, and then it was impossible to identify the market price from the victim. However, the Defendant attempted to receive one of the instant cream cards from the victim, but failed to settle the account after having already been registered as a loss report.
