1. The defendant shall pay to the plaintiff KRW 49,34,235 and KRW 43,470,023 among them, per annum from March 20, 2019 to the day of full payment.
1. Indication of Claim: The Defendant applied for an Internet loan and received a loan of KRW 15.9% per annum from D Co., Ltd. (hereinafter “D”) on December 7, 2017, subject to the repayment of the principal and interest equal for 60 months, subject to the repayment of the principal and interest equal for 60 months.
Since then, the above loan contract was terminated due to the delay of the defendant's performance, D transferred the above loan claim to the plaintiff on September 12, 2018, and notified the defendant of the assignment of the above claim on October 15 of the same year.
Therefore, the Defendant is obligated to pay to the Plaintiff, the assignee of the above loan claim the interest rate of KRW 49,334,235 (i.e., the interest rate of KRW 43,470,023 for overdue interest of KRW 3,568,280 from September 13, 2018 to December 24, 2018) and the interest rate of KRW 43,470,023 from September 13, 2018 to December 24, 2018, the agreed interest rate of KRW 43,470,023, which is the agreed interest rate of KRW 18.9% per annum from the day after the copy of the instant complaint
2. Judgment by service (Article 208 (3) 3 of the Civil Procedure Act).
