피고인은 2019. 1. 5. 19:00경 부산 영도구 B 앞 노상에서, 피해자 C가 자식 자랑을 많이 하는 것에 기분 나쁘게 생각 하고는 말다툼을 하던 중, 피해자 C의 뺨을 1회 때리고 멱살을 잡아 흔들어 바닥에 넘어뜨린 뒤 발로 가슴 부위를 1회 차고 몸을 수회 밞는 등 폭력을 행사하여 피해자의 우측 눈썹 부위가 찢어지게 하는 등의 치료일수 미상의 상해를 가하였다.
