1. The defendant shall pay 54,244,165 won to the plaintiff and 12% per annum from July 5, 2019 to the day of complete payment.

Reasons

1. Determination on the cause of the claim

A. In full view of the overall purport of the pleadings, the following facts are recognized in the statements and images of Gap evidence Nos. 1 through 6 (including paper numbers):

1) The Plaintiff is a person engaged in vessel repair business and tugboat business under the trade name of “D” (hereinafter “instant vessel”).

(2) On December 13, 2018, the Plaintiff concluded a charter contract between the Defendant and the Defendant with the following terms: (a) the Plaintiff’s charter contract between the Defendant and the Defendant to charter the instant vessel to the Defendant.

(hereinafter referred to as “the instant charter contract”). [Article 1 (Indication of Lease Equipment and Contract Price): EO contract amount: KRW 33 million per month: The contract period of the equipment shall be from December 13, 2018 to the completion of the work.

[Article 4 (Payment Method)] The defendant shall pay the user fee calculated under the preceding Article in cash on the 10th day of each month following the month in accordance with the Rules for Payment of Head Office.

[Article 5 (oil and Consumable Articles) From the beginning date of the work to the ending date of the work, all the expendable materials required for the equipment shall be borne by the defendant.

[Article 6 (Ship Repair) The repair of defects and operating parts due to aging shall be borne by the plaintiff, and the defendant shall bear the repair cost due to the damage caused by the reasons attributable to the defendant.

3) 한편 피고는 2018. 12. 14.경 이 사건 선박을 출항시켜 사용하였는데, 조류가 심하고 수심이 �은 곳에서 무리하게 이 사건 선박을 사용하는 등 피고측 과실로 인하여 이 사건 선박의 엔진 감속기와 프로펠러 등이 파손되었다. 4) 피고가 이 사건 선박을 사용하는 동안 발생한 용선료는 합계 39,930,000원, 소모된 유류대금은 합계 4,524,165원이고, 이 사건 선박의 파손 부위를 수리하는데 총 9,790,000원의 수리비가 발생하였다...
