The punishment of the court below against the accused (ten months of imprisonment) is too unreasonable.

Judgment

Although considering the fact that the defendant has been used from his accomplices and that the mistake is divided, each of the fraud of this case does not reach an agreement with the victims even though the sum total of 71,011,812 won is 71,01,812 won, the defendant was not punished by imprisonment several times in the past, and all of the sentencing conditions in the records and arguments of this case, including the defendant's age, character and behavior, environment, circumstances after the crime, etc., are considered, the sentence of the court below cannot be said to be heavy.

In conclusion, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act since it is without merit. It is so decided as per Disposition.
