The litigation costs for retrial shall be borne by the plaintiff.

The grounds of appeal on the grounds of appeal are deemed to fall under the grounds for non-judicial review under the Act on Special Cases concerning the Procedure for Trial by the Supreme Court, and there is no omission in judgment on the grounds of appeal as to the dismissal of a final appeal without further deliberation. Thus, this cannot be viewed as grounds for retrial under Article 451(1)9 of the
