모욕
The prosecution of this case is dismissed.
1. 공소사실의 요지 피고인은 2015. 9. 23. 9:35 경 경기 오산시 B, 201호 자택에서 인터넷 포털 사이트 네이버에 C' 가 작성한 " 한밤 D 측 E에 아이 보낼 생각 단 1% 도 없다" 라는 기사가 게시되자, 아이 디 'F' 로 접속하여 " 꽃뱀 같은 년 어디서 딴 새끼랑 자빠져 자고 새끼 치니까 멀쩡한 놈 OOO 만드네

너 같은 년 조심하게" 라는 댓 글을 작성하고, 계속하여 위와 동일한 방법으로 2015. 9. 24. 9:27 경 " 왜 딴 새끼 자식일 거 들킬까 봐 ㅋㅋ 천상 꽃뱀" 라는 댓 글을 작성함으로써 공연히 피해자 D를 모욕하였다.
2. The above facts charged are the crimes falling under Article 311 of the Criminal Act, which can be prosecuted only when the victim files a complaint under Article 312(1) of the Criminal Act.
According to the records, the victim D does not want punishment against the defendant on May 3, 2016, which was after the prosecution of this case was instituted, and the victim D submitted a written agreement and withdrawal of the complaint.
Therefore, the public prosecution of this case is dismissed in accordance with Article 327 subparagraph 5 of the Criminal Procedure Act.
