Punishment of the crime
On April 28, 2016, the Defendant, without a driver’s license of a motor vehicle around 01:25, driven a motor vehicle B at the section of approximately 1 km from the neighboring road of Suwon-si, Suwon-si to the road of about 895, in accordance with the said old-gu Seoul Metropolitan City.

However, Article 96(1) of the Road Traffic Act provides that a person who is issued a driver's license under the provisions of the Convention on Road Traffic concluded at Geneva in 1949 or in Vienna in 1968 (hereinafter referred to as "international driver's license") may drive a motor vehicle with the international driver's license only for a period of one year from the date of entry into the Republic of Korea.
In such cases, the types of motor vehicles that can be driven shall be limited to those stated in the international driver's license.
Article 41(2) of the Vienna Convention provides that the Contracting Party shall recognize the international driver's license as a valid driver's license (Anex) as an annex to the Convention. Annex 7 of the Convention provides that the international driver's license shall be 148 x 105 m. The name of the issuing State, the agreement on the basis of international driver's license, the effective period, the issuing agency, the place of issuance, the date of issuance, the number of domestic driver's license, etc. shall be printed on the outer page of the front cover, and the driver's license shall not be effective in the territory in which the person in possession is ordinarily residing, and it shall be printed in all the territory of the other Contracting Parties, and at the last place, the matters concerning the driver's name, etc. and the type of vehicles with the effect of the license shall be printed.
