1. The Seoul Southern District Court C's distribution schedule prepared by the above court on March 17, 2020 with respect to the case of compulsory auction of real estate.
In full view of the purport of arguments as to Gap evidence 1 and 2, Gap evidence 3, Eul evidence 4-1 and Eul evidence 2, the compulsory auction (hereinafter "instant compulsory auction") has commenced as to Eul-gu Seoul Metropolitan Government E-building 2 F, as stated in paragraph (1) of this Article. On March 17, 2020, the plaintiff was paid 6,080,823 won out of the amount of claim 18,423,008 won as provisional attachment creditor for D, 30,000 won, 30,000 won, 20,000 won, 30,000 won, 20,000 won, 30,000 won, 20,000 won, 30,000 won, 20,000 won, 30,000 won, 20,000 won, 36,05,000 won, 20,000 won, 36,00
Therefore, the Defendant received dividends of KRW 1,303,00 in excess of the principal and interest (=503,020 won + KRW 503,020 x 0.05 x (62/36), 009 x less than KRW 0.06 x (66) accrued up to that time in the course of the compulsory auction at H in the preceding court’s lower court’s lower court’s lower court’s lower court’s lower court’s lower court’s distribution of KRW 1,303,00,000 and received KRW 996,751 as if the claim remains in the course of the compulsory auction at issue. As such, the Defendant reported the claim and received dividends of KRW 96,751,00 for the Defendant, KRW 96,751, and KRW 6,080,823,574 (=6,080, KRW 823,96,751).
The plaintiff's claim shall be accepted on the grounds of its reasoning, and it is so decided as per Disposition.
