Defendant shall be punished by a fine of three million won.
If the defendant does not pay the above fine, 50,000 won shall be one day.
Punishment of the crime
1. Embezzlements of lost possession;
A. On March 2010, the Defendant found one copy of the resident registration certificate owned by the victim B, which was lost, at the beginning of Busan and lower court.
The Defendant did not take necessary procedures, such as returning the acquired property to the victim, but did so.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
B. On September 2012, 2012, the Defendant acquired one copy of the resident registration certificate owned by the victim C, which was stolen, in the French land below Busan.
The Defendant did not take necessary procedures, such as returning the acquired property to the victim, but did so.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
2. Illegal uttering of official documents;
A. On May 9, 2013, at around 12:30, the Defendant was demanded to present an identification card from the employee F while opening a mobile phone at the mobile phone sales store of “E” located in Busan Jin-gu, Busan.
Therefore, the defendant presented B's resident registration certificate under the name of the head of Busan Northern District Office, which is an official document in possession, as if the defendant was the resident registration certificate of the defendant, and illegally displayed the official document.
B. On May 9, 2013, around 13:00, the Defendant was required to present an identification card from the employee I while opening a mobile phone at the mobile phone sales store of “H” located in Busan Jin-gu, Busan.
Therefore, the defendant presented B's resident registration certificate under the name of the head of Busan Northern District Office, which is an official document in possession, as if the defendant was the resident registration certificate of the defendant, and illegally displayed the official document.
C. On May 9, 2013, around 16:00, the Defendant was required to produce identification cards from employees L at the mobile phone sales store of “K” in Busan JJ, Busan, and at the same time, at the mobile phone sales store of “K.”
The defendant is the head of the Busan Geum-gu, which is an official document in possession.
