1. Basic facts
A. The Plaintiff is a reconstruction association which completed the registration of incorporation on January 12, 2012 with the authorization for the establishment of a housing reconstruction project on December 29, 201, in order to implement the housing reconstruction project within 39,145 square meters of Priwon in Namyang-si, Namyang-si (hereinafter “instant project zone”).
The Defendants were the Plaintiff’s members, who owned each real estate listed in the separate sheet No. 2 (hereinafter “instant real estate”) located within the instant business zone.
Meanwhile, on March 12, 2018, Defendant B completed the registration of transfer of ownership for 55/5,980 shares among the real estate listed in Attached Table 2 List No. 2 List No. 1 and the real estate listed in Attached Tables No. 22 through 26, and Defendant J completed the registration of transfer of ownership for 55/5,980 shares among the real estate listed in Attached Table No. 2 List No. 2 List No. 9 and each real estate listed in Attached Tables No. 22 through 26, 2018.
B. On December 14, 2016, the Plaintiff obtained authorization for the implementation of the project from the Namyang City Mayor, and received the authorization for the implementation of the project on September 25, 2017.
After December 13, 2017, the Plaintiff notified the Plaintiff’s members, including the Defendants, to conclude a sales contract by setting the period from December 26, 2017 to December 28, 2017.
C. The Defendants did not conclude a sales contract with the Plaintiff, and currently occupy the instant real estate.
Article 11(3) of the Plaintiff’s articles of incorporation provides that “A person who fails to enter into a sales contract during the period of the conclusion of the sales contract by the association under Article 45(6) shall be disqualified as a member on the date following the end of the conclusion of the sales contract,” and Article 45(4) and (5) of the Plaintiff’s articles of incorporation provides that “if a partner fails to enter into the sales contract,
