A defendant shall be punished by imprisonment for not less than one year and six months.
The defendant is an applicant for compensation of KRW 683,00 and the defendant is an applicant for compensation.
Punishment of the crime
On July 23, 2019, the Defendant posted a letter “sale of gallons” on the Internet’s website “E” on a closed-end market site (E), and the victim F who reported and contacted the letter “on a mobile phone will make a mobile phone if he transfers KRW 553,50 to an internal account” but the Defendant did not have any intent or ability to sell a mobile phone even if he/she receives money.
As such, the Defendant, by deceiving the victim, received KRW 553,50 from the victim to the account of community credit cooperatives (G) in his/her name on the same day, and acquired KRW 553,500 as the sale proceeds, and as shown in the separate crime list (1) from July 23, 2019 to August 26, 2019: Provided, That the criminal account No. 8 of the same year is corrected to “H community credit cooperatives I” in the name of H.
In total eight times, a total of 3,373,50 won was received from eight victims in the same way and acquired through deception.
On December 6, 2019, the Defendant posted a letter stating “10 gallon No. 10 and gallon No. 10 fl. f. f. f. f. f. f. f. f. f. f. f. c. f. f. c. f. f. f. f. f. f. c. f. f. f. f. f. f. f. f. f. f. f. f. f. f. f. f. f. f. f. f. f. f. f. f. f. f. f. f. f. f. f. f.
As such, the Defendant, by deceiving the victim as such, received KRW 1,353,00 from the victim to the account of community credit cooperatives (I) in H three times from December 6, 2019 to December 7, 200 of the same year, and thereafter, as indicated in the List of Crimes (2) from that time until May 27, 2020: Provided, That the date of No. 7 is corrected to the date of December 9, 2019.
