1. 공소사실의 요지 피고인은 ( 유 )B 소속 택시 운전사로, 2017. 6. 10. 01:20 경 광주 동구 지산동 지 산 4 거리 노상에서 광주 동부 경찰서 소속 경찰관에게 신호위반으로 통고 처분 받은 사실에 격분하여, 피해자에게 “야 이, 씨 발 놈 아 이렇게 스티커 끊고 다니면 재밌냐,
너 내려봐 이 씨 발 새끼야 내가 인사를 그렇게 했는데도 안 봐줘 , 이 개 좆같은 호로 새끼야, 양아치 같은 짓거리 하고 다니냐 ,
In other words, “the same fluort” publicly insulting the victim.
2. The offense of insult is an offense falling under Article 311 of the Criminal Act, and a public prosecution may be instituted only when a criminal complaint is filed under Article 312 of the Criminal Act.
On August 14, 2017, after the prosecution, the victim submitted a letter of withdrawal of complaint to this court. Thus, the prosecution of this case is dismissed in accordance with Article 327 subparagraph 5 of the Criminal Procedure Act.
