A defendant shall be punished by imprisonment for a term of two years and a fine of one million won.
If the defendant does not pay the above fine, it shall be gold.
Punishment of the crime
On May 1, 2017, the Defendant made a false statement to the effect that “The 2017 Highest 1167 was sold to KRW 145,00,00,” by communicating the victim with the above site hosting at a nearby place in the city of Won-si, the Internet site “Neer Highest Bas”. The Defendant made a false statement to the effect that “The NAE is sold to KRW 145,00,00.”
However, even if the defendant receives money from the injured party, he did not have the intention or ability to sell the money normally.
Nevertheless, the Defendant received a total of KRW 7,50,500,000 from the victim's personal account (O) in the name of the Defendant from the victim, from around 45 times until August 12, 2017, including the remittance of KRW 145,00 from the victim's personal account under the name of the Defendant under the name of the Defendant, from that time to August 12, 2017.
Accordingly, the defendant was given property by deceiving the victim.
"2017 Highest 1298" and "China Highest 1298", which are used to deal with used goods, acquired goods from many unspecified victims, and the account in his/her name was registered as a fraud account in the "qt", which is a fraud information sharing site, the Defendant: (a) caused the buyer of the goods to transfer the goods to the account in his/her own name in the Korean bank in the name of P, known to him/her; (b) caused the buyer of the goods to transfer the goods to the account in the name of the P, and (c) caused the Gu to mislead the purchaser of the money deposited in the account; and (c) sent the money
In other words, the intent was to acquire money by means of receiving money from P by means of money transfer.
On July 6, 2017, the Defendant posted a soup, making soup, a false statement stating that “I will send Aphones to I return money to IE if I transfer money” to IEN, using a mobile phone, and that “I will send IEN to IE if I transfer money.”
However, even if the defendant receives money from the injured party, he will sell the above things normally.
