The judgment below

In light of the records, the court below is just to reverse the judgment of the court of first instance on the ground that there is no proof of crime as to the facts charged in this case, and it did not err by exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules or by misapprehending the legal principles on the criminal intent to acquire by deception in fraud, contrary to the allegations

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
