Basic Facts

The Plaintiff entered into a contract with the Defendant to accept a subcontract for the construction of a row house (hereinafter “instant construction”) from the Defendant in Seopo-si, Seopo-si (hereinafter “instant construction”).

(1) The Plaintiff received KRW 0,00,000,000 from the owner of the instant construction project or from the Plaintiff on April 20, 2018 as the aggregate of the construction work price of KRW 0,00,00,000 from December 4, 2017 to April 30, 2018; KRW 0.1% from April 20, 2018 to June 30, 2018; KRW 0,00,000; KRW 0.1% from the owner of the instant construction project; KRW 0,00,00,000; KRW 0.1% from the 0,00,00,000; and KRW 0,000 from April 20, 2018 to April 20, 2018; and KRW 0,000,000,000 for construction price of the instant construction project or around 0,008.208.

[Ground] A without dispute, Gap evidence Nos. 1, 2, 5, 6, Eul evidence Nos. 5, 9, and 10 (including serial numbers; hereinafter the same shall apply), and the purport of the whole pleadings as to the plaintiff's claim against the plaintiff as to the plaintiff's main claim, the plaintiff was paid only 385,400,000 won out of the total construction cost under each of the contracts of this case (i.e., non-f., 215,40,000 won for 130,00,000 won for tin work) under each of the contracts of this case.

Therefore, the defendant is obliged to pay the remaining construction cost of KRW 176,600,000 to the plaintiff and delay damages.

The defendant alleged as to the defendant's defense and counterclaim claim against the main claim of this case has the following claims against the plaintiff in relation to the construction work of this case. They set off these claims against the claims for delay and their waste disposal and cleaning work.
