1. Revocation of a judgment of the first instance;

2. The plaintiff's claim is dismissed.

3. All costs of the lawsuit shall be borne by the Plaintiff.

Reasons

1. Basic facts

A. The Plaintiff is a juristic person established for the purpose of managing multi-family housing, etc., and the Defendant is an organization comprised of occupants of the Madodoobbb apartment (hereinafter “instant apartment”) located in the 65-ro, 17-ro, north-gu, Seopo-si.

Article 1 (Purpose) The purpose of this Agreement is to clarify the management work of the apartment of this case, which is constructed by “A” (Trido Housing Co., Ltd.) and the management work of the apartment of this case, by stipulating all matters concerning the management work in the entrusted management work.

Article 3 (Scope of Management Affairs) The entrusted management of this contract shall comply with the scope of the following management affairs prescribed in Article 55 of the Enforcement Decree of the Housing Act:

1. Matters prescribed by the Housing Act and the Enforcement Decree thereof;

2. Maintenance, repair and safety management of common areas of multi-family housing, incidental facilities and welfare facilities owned by occupants;

3. Guard, cleaning, disinfection, and garbage disposal within the collective housing complex;

4. Collection of the management expenses and fees, vicarious payment of public imposts, purchase of fire insurance;

5. Collection and accumulation of long-term repair appropriations;

6. Enforcement of matters determined by the rules for collective housing management and those determined by the council of occupants' representatives;

7. Matters prescribed by the Housing Act, relevant Acts and subordinate statutes and management regulations.

8. Matters concerning common interests of occupants and matters deemed necessary for “A” under Article 5;

1. The period of management of multi-family housing in “B” shall be one year from the commencement date of occupancy on November 201, but the period shall automatically terminate regardless of the contract period when a majority of prospective occupants forms a council of occupants’ representatives by completing occupancy, and a council of occupants’ representatives selects a housing management enterprise in the council of occupants’ representatives or an autonomous management organization

Article 7 (Organization of Personnel for Entrusted Management)

1. A manager and personnel expenses (such as wages, various allowances, retirement allowances, bonuses, etc.) including the head of the management office shall be determined by mutual consultation between A and B.

2. “B” is the Housing Act.
