A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Punishment of the crime
Despite the fact that the Defendant is not a narcotics handler, the Defendant handled the Meteptop clopule (one philopon; hereinafter “philopon”) and marijuana, which is a local mental medicine, as follows:
1. Violation of the Narcotics Control Act;
A. On May 6, 2018, the Defendant, on May 6, 2018, traded phiphones, in a place where the address of May 6, 2018 is unknown, decided to contact with D and purchase phiphones, and then wired 400,000 won to the non-personal account designated by the above person without the name. On the same day, the Defendant purchased phiphones by means of finding approximately 0.5 g of the phiphones which the above non-person was hidden in advance at the bottom of the signboard located in the commercial building located in the Gangnam-gu Seoul Stationdong, Gangnam-gu, Seoul.
2) On May 16, 2018, the Defendant, on May 16, 2018, decided to contact a person without a name (D) who sells the penphone with D at a place where his/her address is unknown, to purchase the penphone, and then remitted the price of KRW 1,200,000 to the non-account designated by the above person without a name, and on the same day, purchased the penphone by means of finding approximately 2 g of the penphone, which was concealed in advance by the person without a name in front, in the letter box near the G Station located in Gwanak-gu in Seoul Special Metropolitan City, Seoul Special Metropolitan City.
3) On July 30, 2018, the Defendant, on July 30, 2018, sold phiphones to D at a place where the address of around 20:09 is unknown, to purchase phiphones, to contact H, I (D ADJ, D 'K') to purchase phiphones, and then to transfer 200,000 won from the virtual account (Account Number: L) designated by H et al. to the bank account designated by K et al., and on the same day, transferred 20:43 around the same day to the building located in Gangnam-gu Seoul Metropolitan Government, where H et al. moved from the bottom of which H et al. was put in place. 14g, and traded phiphones by means of finding 0.14g g of phiphones.
B. On February 5, 2018, the Defendant, who attempted to sell or purchase phiphones, knows the address around 16:31.
