A. The conclusion of the first construction contract and the completion of the construction work (1) The Plaintiff is a company established for the purpose of soil construction business, steel-line container construction business, etc.

(2) On November 19, 2012, the Plaintiff concluded the first construction contract with the Seoul Metropolitan Government Government Procurement Service for the construction of the Gangnam-gu Office building (hereinafter “instant construction”).

The name of the construction project: The name of the project: The National Tax Service Gangnam-gu Seoul Regional Tax Office. The contract date: Plaintiff. The contract date: KRW 3,280,830,00 (in accordance with a subsequent change in design, increased to KRW 3,305,491,00). The additional total construction amount: KRW 9,850,182,90 (in this case, the increase to KRW 9,874,843,90). The date of commencement: on November 26, 2012: The date of completion of the first construction project: on November 1, 2013, the total construction amount: KRW 3,280,830,490: the total construction amount; on July 18, 2014, the total construction amount of KRW 305,500: the total construction amount; on July 31, 2013, the Plaintiff and the Defendant paid KRW 105,510: the total construction ratio of the construction project (total 2: 3: the Plaintiff’s 10: the total construction share of the construction project.

B. The Plaintiff and the Defendant’s advance payment (1) concluded the second construction contract and the Defendant’s advance payment (i) were submitted to the Defendant with a guarantee period for an advance payment of KRW 600 million from the Construction Mutual Aid Association from November 1, 2013 to July 30, 2014, respectively.

(2) On November 26, 2013, the Plaintiff and Roto Construction entered into the second construction contract on the instant construction project (hereinafter “the instant second construction contract”) with the Defendant.
