1. On December 10, 2004, the Plaintiff borrowed 50 million won to the Defendants without fixing the interest and the due date for payment. At the time, the Defendants promised to jointly and severally repay the above obligation.
Therefore, the defendants are jointly and severally liable to pay to the plaintiff 50 million won with 5% per annum under the Civil Act from the day after the delivery of a copy of the complaint of this case to the day when the judgment is rendered, and 20% per annum under the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings from the next day to the day of full payment.
(However, since the statutory interest rate under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings was reduced to 15% per annum from October 1, 2015, claims for damages for delay in excess of this rate shall not be accepted).
