The plaintiff's claim against the defendants is dismissed in entirety.
Litigation costs shall be borne by the plaintiff.
1. The facts below the underlying facts may be found either in dispute between the parties or in Gap evidence 1 to 5, 8, 11 to 14 (including a serial number; hereinafter the same shall apply), and Eul evidence 11, together with the whole purport of the pleadings.
From August 1, 2008 to August 26, 2012, Defendant C, from August 27, 2012 to June 11, 2013, and Defendant D, from August 27, 2012 to June 11, 2013, were in office as the head of the Seoul Branch’s Compensation Service Center. Defendant D, from June 12, 2013 to March 31, 2014, was in office as the head of the Seoul Branch’s Compensation Service Center, and was in office as the head of the Seoul Branch’s Compensation Service Center following the reorganization of the Plaintiff’s organization from April 1, 2014 to March 10, 2015.
B. From February 1, 2010 to June 11, 2013, Defendant E served as the head of the Compensation Guidance Department for the Mutual Aid Association headquarters established by the Plaintiff, and Defendant F served as the head of the Compensation Guidance Division established by the Plaintiff from November 1, 201 to December 3, 2012.
C. From April 12, 2007 to March 2015, Nonparty G served as the director in charge of compensation service for the Seoul District Compensation Service Center of the Plaintiff’s Seoul Branch’s Mutual Aid Association. If a medical institution treating victims of traffic accidents caused by chartered buses affiliated with the Mutual Aid Association claims medical expenses to the Plaintiff, Nonparty G was in charge of examining whether and not to pay the fees.
G During the period from August 13, 2008 to December 19, 2014, the victims of traffic accidents who have already completed medical treatment enter false medical treatment into the medical treatment payment statement as if they have claimed medical treatment expenses from the relevant medical institution, and enter the H hospital or I-type department, which has already been closed, into each deposit account of their mother J’s national bank account (Account Number K) and then puts the approval proposal, and then receives total of KRW 617,102,690 in total over 135 times by means of computer approval using the compensation division or the approval password of the head of the center.
