1. The defendant shall pay to the plaintiff 169,504,162 won and the amount of KRW 95,00,000 among them, from June 26, 2015 to the day of full payment.
According to the purport of Gap evidence Nos. 1 through 5 and the whole pleadings, the plaintiff extended a loan of KRW 95,00,000 to the defendant on June 28, 2012 at the maturity date of February 28, 2013; the interest rate of KRW 12% per annum; and the rate of arrears at the highest rate of 24% per annum; as of June 25, 2015, the loan principal of KRW 95,00,000; interest of KRW 64,06,806; KRW 10,437,356; and KRW 169,504,162 per annum.
According to the above facts of recognition, the Defendant is obligated to pay to the Plaintiff damages for delay at the rate of 24% per annum from June 26, 2015 to the date of full payment, which the Plaintiff seeks with respect to the above KRW 169,504,162 as well as the loan principal of KRW 95,00,000.
The plaintiff's claim of this case shall be accepted on the grounds of its reasoning, and it is so decided as per Disposition.
