A. On July 5, 197, the Plaintiff completed registration of preservation of ownership on the D 195 square meters of the window of Changwon-si, Changwon-si, and owned a building listed in the attached Table (hereinafter “instant house”) on that ground.

B. On June 27, 1971, with respect to the 122 square meters in the Changwon-si Counter. (hereinafter “instant land”), each ownership transfer registration was made in sequence in the Defendant’s order on December 6, 1975, in the future of F on November 22, 1983, in the future of H on February 24, 1987, in the future of H on April 12, 201, and July 1, 2016.

다. 이 사건 주택의 부지에는 이 사건 토지 중 별지 ⑶도면 표시 11, 12, 13, 8, 11의 각 점을 순차 연결한 선내 ㈏부분 3㎡(별지 ⑴도면 표시 8, 11, 12, 13, 14, 16, 8의 각 점을 순차 연결한 선내 ㈏부분 3㎡와 동일하다)가 포함되어 있는데, 구체적으로는 별지 ⑴도면 표시 8, 11, 12, 13, 14, 16, 8의 각 점을 순차 연결한 선내 ㈏부분 3㎡에 스레트 플라스틱기와 지붕이, 같은 도면 표시 11, 12의 각 점을 순차 연결한 부분에 높이 약 110cm 폭 약 10cm의 콘크리트 담장이, 같은 도면 표시 14, 15, 16, 14의 각 점을 순차 연결한 선내 ㈐부분 1㎡에 블록조 건물벽체가 각 설치되어 있다.

가. 본소청구에 대한 판단 원고는 1977. 7. 5.부터 이 사건 토지 중 별지 ⑵도면 표시 1, 21, 22, 23, 10, 1의 각 점을 순차 연결한 선내 ㈏부분 8㎡를 이 사건 주택을 위한 통로로, 별지 ⑶도면 표시 11, 12, 13, 8, 11의 각 점을 순차 연결한 선내 ㈏부분 3㎡을 이 사건 주택의 부지로 각 점유해 왔는바, 피고에 대해 위 각 토지부분에 관하여 2017. 7. 5. 취득시효완성을 원인으로 한 소유권이전등기절차의 이행을 구한다고...
