The prosecution of this case is dismissed.
1. Around 01:50 on February 4, 2013, the Defendant assaulted the victim’s head by putting the victim’s head into 2-3 time in a breath and spathing spath, by putting the victim’s victim C (age 53) into a road in front of Guro-gu Seoul Metropolitan Government, on the ground that it is bad for the victim’s breath.
2. This part of the facts charged is a crime falling under Article 260(1) of the Criminal Act and cannot be prosecuted against the victim’s explicit intent pursuant to Article 260(3) of the Criminal Act. Since the victim expressed his/her wish not to punish the defendant on or around June 13, 2013, the prosecution of this case is dismissed pursuant to Article 327(6) of the Criminal Procedure Act.
