1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
The plaintiff around April 2008 operated an entertainment tavern by leasing the first floor of the building under the Yeongdeungpo-gu Seoul Metropolitan Government Building, and the defendant is an organization composed of the occupants of the above B building (the persons holding the ownership, possession right, lease and other equivalent rights to all or part of the building, who actually contributed expenses necessary for the management and operation of the building). There is no dispute between the parties.
On January 201, the Plaintiff claimed KRW 1,530,000,000,000,000,000,000 won for the construction cost, such as a ceiling, and KRW 2,5330,00,000,00,000 for the installation cost, and KRW 37,000,000,000 for replacement of heating and moisture, and KRW 57,360,00,00 for business losses during the period from February 2, 2011 to 37, and KRW 57,360,00 for each of the above items (i.e., the sum of KRW 1,530,00,000 for 2.37,000,000 for 37,000,000 for 37,000 won for each of the above items).
The defendant asserts that he is responsible for compensating for the damages.
According to the statements and images of evidence Nos. 7 and 14-1 through 16, and the witness C’s testimony, ① the building was completed on May 25, 1978 and the public toilets inside the building were worn out, and then the Defendant Steering Committee decided to perform the renovation and repair works around February 201, 201, and ② the Plaintiff’s entertainment drinking houses, including the Plaintiff’s entertainment drinking houses, were destroyed, and the Defendant’s affiliated management office was unable to take ad hoc measures each time, and the employees of the Defendant’s affiliated management office confirmed and taken ad hoc measures, such as ice Luxembourg, Luxembourg, part of the mouth and walls, wooden mold, and gate dykeing the Plaintiff’s shop. < Amended by Act No. 10548, May 25, 2015>
