1. All of the plaintiffs' claims are dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
1. Basic facts
A. On September 23, 1996, the Seongdong-gu Limited Partnership purchased A and B land from the Korea Land Corporation in the Gyeong-do, Gyeong-nam-do. On March 4, 1997, the company obtained approval of the apartment construction project plan for the above land from the Common Young-gu, and completed the registration of ownership transfer for the above land on January 9, 1998. Since January 9, 1997, affiliate companies failed to carry out apartment construction projects due to their bankruptcy, and on February 1, 1998, the above land was entrusted to the Defendant.
B. On November 200, the Defendant approved the modification of the business plan to newly construct a rental apartment converted for sale in lots through a five-year rental period under the former Housing Construction Promotion Act (amended by Act No. 6732 of Aug. 26, 2002), etc., from the Si-Yan market, the Defendant entered into a lease contract with the Plaintiffs on March 30, 2002, and around July 29, 2002, the Plaintiffs moved into a lease agreement with the Plaintiffs under the above lease agreement, and around August 29, 2002, the Plaintiffs moved into a lease apartment of land A and B (hereinafter “instant lease apartment”).
C. Around June 2009, the Defendant approved the rental apartment of this case to convert it to the price determined in accordance with the criteria to be seen in the table below. From June 25, 2009 to July 1, 2009, the Defendant concluded a sales contract with the Plaintiffs having preferential right to sell (hereinafter “instant sales contract”) as lessee. The Plaintiffs’ purchase price is as stated in the corresponding column of the claim amount by the Plaintiff.
