1. It shall be confirmed that each real estate listed in the separate sheet is owned by the plaintiff;
2. The costs of the lawsuit are assessed against the defendant.
Considering the overall purport of the arguments in Gap evidence Nos. 1 through 6 (including various numbers), the Confucian Schools Foundation established as an incorporated foundation on August 30, 194 after obtaining permission for establishment on August 30, 1948, and was established as the incorporated foundation on May 30, 195. The Foundation was a Confucian Schools Foundation in the jurisdiction of the plaintiff. Each of the real estate in this case was unregistered and its owner was also a person holding land cadastre, and it was recognized that the real estate in this case was in the state of unreexponed and unexponed, and Article 194 of the Military Court Act No. 194 of May 17, 194, which was enacted and implemented on May 17, 194, provides that the Confucian Schools Property shall be the basic property of each Do incorporated as a foundation, and Article 13 of the Enforcement Decree provides that "the rights and obligations concerning the Confucian Schools Property shall be succeeded only to the Confucian Schools Property that occurred before its enforcement."
According to the above facts, each of the instant real estate was acquired at once by the Confucian School Foundation in the form of circumstances, and thereafter, it shall be deemed that it belongs to the Plaintiff and is owned by the Plaintiff pursuant to the Gun Government Act and subordinate statutes, and as long as the Defendant contests this, the Plaintiff has the interest to seek confirmation of ownership against the Defendant for the preservation of ownership.
The plaintiff's claim is accepted.
