A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
1. Forgery of private documents;
A. On January 29, 2010, the Defendant: (a) indicated that “In the event that the amount of the property right to the said land cannot be repaid (creditor E) cannot be reimbursed with respect to the land of 12 parcels, such as transfer/acquisition contract, and the Gyeong-gun, Chungcheongnam-gun, Chungcheongnam-gun, the land location, the Defendant promised to transfer/acquisition the said land at will; (b) on January 29, 2010; and (c) indicated “the borrower: F)” on the blank paper located in the C Office located in the Gandong-gun, Chungcheongnam-gun, the Defendant arbitrarily sealed the F seal kept in his/her name.
Accordingly, for the purpose of uttering, the Defendant forged a letter of transfer/acquisition contract in F, a private document on rights and obligations.
B. Around November 12, 2012, the Defendant: (a) stated that “The Defendant would pay KRW 131 million in total to E who is a creditor” at the H parking lot located in Daegu Northern-gu, Daegu-gu, by using an official approval color pen to the lower end of the payment note; (b) stated that “I will undertake to dispose of all the assets owned by F without the consent of the obligee E” and affix the F seal next to that name.
Accordingly, for the purpose of exercising, the Defendant forged a letter of payment, which is a private document on rights and obligations entered in the name of F as a guarantor.
2. The Defendant forged securities at the date, time, place, as indicated in Article 1-2(b), stating “F” at the bottom of the cover of the Promissory Notes marked as “B” and “C” and then forged the entry of F’s seal on the same date, place, such as the entry of the list of crimes in the separate sheet, and the entry of the entry of F as “F” on the rights and obligations of eight securities, the name of which is entered as a guarantor, as indicated in the list of crimes in the separate sheet.
