Purport of claim and appeal
[Claim]
1. On August 26, 2015, the Plaintiff and the Defendant concluded a contract with the following terms and conditions (hereinafter “instant contract”) under the name of “A contract for the provision of services for the Development of the Rodrid Certificationer” (hereinafter “instant contract”).
The purpose of Article 1 (Purpose) is to provide services to the plaintiff in order to establish the defendant's project, and to prescribe all necessary matters, such as rights and duties, according to the defendant's payment.
Article 2.(Contract Term, Inputs and Development Support Services)
1. Contract term: From August 27, 2015 to September 26, 2015 (1 month);
2. Human resources invested: Article 3 (Methods of Payment and Defects Guarantee) of the M/M total amount of 1M/M;
1. Contract amount: 5,800,000 won (excluding value-added tax);
2. Type of payment: Monthly payment;
3. Payment terms: Payment in cash of 5,800,000 won within the 15th day of the following month.
Article 4 (Transfer of Rights and Obligations)
1. The Plaintiff may not transfer or entrust all or part of the rights and obligations under this contract to a third party.
3. No disclosure shall be made to the outside any part of or any part related to the intangibles or parts of this project computed, and shall be paid legal damages in the event of a breach.
Article 5 (Management of Speculative Human Resources)
1. During the contract period, the defendant may request the plaintiff to replace inputs who are unsuitable or disqualified during the contract period, and the plaintiff must comply with the request unless there is any special reason not to do so.
In addition, if it is necessary to replace human resources invested by the plaintiff due to unavoidable reasons, the plaintiff must obtain prior approval from the defendant and prepare official documents for the replacement human resources.
In addition, the defendant's replacement of human resources should be carried out, but the transfer period should be treated within at least one week.
4. All directions, labor management, safety management, sanitary management, etc. regarding the Plaintiff’s inputs shall be subject to the Plaintiff’s command, management, and compensation liability, and all the Plaintiff’s inputs shall be subject to the Plaintiff’s commission.
