1. The Plaintiff’s assertion and judgment are jointly and severally liable for the Plaintiff to pay 3,700,000 won to the Plaintiff for expenses incurred in repairing the said storm, as well as damages for delay to the Plaintiff, on July 9, 2012, on the grounds that the Defendant B installed a steel net in the drainage hole around the Plaintiff’s house, and the Defendant C changed the course to the sandline from the waterways around the Plaintiff’s house.
Considering the overall purport of the pleadings as a result of the on-site inspection of evidence Nos. 2-1 through 7, evidence Nos. 2-1 through 6, evidence Nos. 6-1 through 6, and evidence Nos. 6-2, and evidence Nos. 3, and the whole purport of the pleadings, Defendant B installed a wire network in the drainage hole around Plaintiff’s house. Defendant C established a sand position board in the number of channels around Plaintiff’s house; Defendant C, on July 6, 2012, was 249.3 meters at the time when Plaintiff and Defendants were residing, and part of the Plaintiff’s wall’s house was collapsed around that time.
However, as seen earlier, Defendant B installed a wire network in the drainage hole around Plaintiff’s house, and Defendant C is not sufficient to recognize a substantial causal relationship with the result that part of the Plaintiff’s fences around Plaintiff’s house collapsed due to a heavy rain. The Plaintiff’s aforementioned assertion against the Defendants is without merit, on the grounds that there is no evidence to acknowledge otherwise.
2. The plaintiff's claim against the defendants is dismissed in its entirety as it is without merit. The judgment of the court of first instance is just in its conclusion, and the plaintiff's appeal against the defendants is dismissed in its entirety as it is without merit. It is so decided as per Disposition.
